Abstract

Due to the different realities in which they are immersed, higher education institutions also face different problems concerning the faculty and the administrative staff. Private education institutions are very free to hire staff under the Labor Code, while public sector institutions under the Administrative By-Laws and institutional rules are subject to conditions that make these legal concepts more rigorous still. Therefore, both realities are not comparable regarding the possibility of hiring staff when needed.
