Abstract

The law of cultural donations has been an important tool for raising funds for initiatives of this type, enhancing the role of the private sector in this respect with the universities as one of the main beneficiaries. The new regulations that govern the law (also known as Law Nº 19.885) have given rise to several difficulties, thereby complicating a method which was working well. Potential amendments to revert the system to its original viability by adding flexibility to the new limits and restrictions should also address other limitations demonstrated during its implementation. For instance, they should favor the association of higher education institutions with other centers, thereby encouraging their role as organizations that promote culture and that can contribute to place all applicants on the same level while encouraging a better territorial distribution of donations to avoid an excessive concentration of grants in a single area.
